A court decision was issued in favor of our client in a contentious divorce case, assigning fault to the husband on the grounds of adultery. The Court recognized adultery as a rebuttable presumption and, following full evidentiary proof, granted the dissolution of the marriage with the husband deemed at fault. At the same time, exclusive custody of the minor children was awarded to our client, taking into account their best interests and the serious disruption of the family environment.
The Court acquitted our client of the charges of threat and insult, recognizing that he acted under the pressure of justified indignation. His reaction was triggered by the systematic violation of his right to communicate with his minor child by his former spouse. The Court took into account the particular circumstances of the case and ruled that our client’s conduct did not constitute a criminally punishable act.
We achieved the complete dismissal of two claims brought by the plaintiffs, who alleged embezzlement of funds. The decisions, both at first and second instance, fully vindicated our client, rejecting all allegations of embezzlement as unfounded in substance.
